In 1990, Congress established the EB-5 Program with the aim of fostering economic growth in the United States through job creation and capital investment from foreign investors. In 1992, Congress introduced the Immigrant Investor Program (Regional Center Program), designating EB-5 visas for those participating in USCIS-approved regional center projects that promote economic development.

On March 15, 2022, President Biden signed the EB-5 Reform and Integrity Act as part of the Consolidated Appropriations Act, 2022 (Public Law 117-103). This legislation introduces new requirements and extends authorization for immigrant visas under the Regional Center Program through Sept. 30, 2027.

APPLICATION PROCESS AND TIMELINE
YEAR 1

Process Initiation & Filing of I-526 Petition

Client pays retainer to initiate the process. Make a qualifying investment and submit an I-526 petition to USCIS. Guidance includes document preparation and proof of funds evidence. Choose direct business investment or regional center project. Funds are transferred to the enterprise bank account or escrow.

YEAR 2

Applying for Conditional Lawful Permanent Residence

After I-526 approval (and if a visa number is available), apply for conditional lawful permanent residence through consular processing (outside U.S.) or adjustment of status (inside U.S.). Interview is arranged if applicable, then entry to the U.S. with CLPR status.

YEAR 3

Receiving the Green Card (I-829)

File I-829 with evidence of maintaining investment and job creation. Can be filed 21 months after CLPR approval and before expiry. Upon approval, a 10-year renewable Green Card is issued. After 5 years as permanent resident, client may apply for U.S. citizenship (subject to requirements).
